These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player," "User," or "you") and ph44 ("ph44," "we," "us," or "our") governing your access to and use of the ph44 online gaming platform available at ph44.xyz ("Platform").

By accessing the Platform, creating an account, making a deposit, or placing any wager, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must immediately cease using the Platform.

• You must be a natural person and not a corporation, partnership, trust, or other legal entity.

• You must not be an employee, contractor, director, officer, or agent of ph44, or an immediate family member of any such person.
• You must not have been previously excluded or suspended from the ph44 Platform or any affiliated gaming service.

ph44 reserves the right to request proof of age, identity, and address at any time. Failure to provide satisfactory documentation within the timeframe specified by ph44 may result in account suspension and withholding of pending withdrawals pending verification.

To access the full range of ph44 services, you must create a registered account. The following conditions apply to account registration and maintenance:

• One Account Policy: Each player is permitted to hold only one active account on the ph44 Platform. The creation of multiple accounts by a single individual is strictly prohibited and constitutes grounds for immediate account closure and forfeiture of balances.
• Accurate Information: You must provide accurate, complete, and current information during registration, including your full legal name, date of birth, residential address, and valid contact details. Providing false or misleading information is a material breach of these Terms.
• Account Security: You are solely responsible for maintaining the confidentiality of your username and password. You must not share your login credentials with any third party. ph44 will not be liable for any losses arising from unauthorized access to your account resulting from your failure to maintain adequate security.
• Notification of Unauthorized Access: You must notify ph44 immediately if you suspect that your account has been accessed without your authorization. Contact our support team as soon as possible to secure your account.
• Account Non-Transferability: Your ph44 account is personal to you and may not be transferred, sold, or assigned to any other person under any circumstances.

ph44 reserves the right to refuse account registration to any applicant at its sole discretion, without being required to provide a reason for such refusal.

ph44 supports a range of payment methods commonly used by Filipino players, including GCash, PayMaya, BPI, BDO, and Metrobank. The following terms apply to all financial transactions on the Platform:

4.1 Deposits

• All deposits must be made using payment methods registered in your own name. ph44 does not accept deposits from third-party accounts.
• Minimum and maximum deposit limits apply and are displayed at the point of transaction. These limits may vary by payment method and account verification status.
• Deposits are credited to your ph44 account upon confirmation from the relevant payment provider. ph44 is not responsible for delays caused by third-party payment processors.
• ph44 does not charge fees on deposits; however, your payment provider may apply their own transaction fees, for which ph44 bears no responsibility.

4.2 Withdrawals

• Withdrawals may only be made to a payment account registered in your own name and matching the details on your ph44 account.
• Before processing any withdrawal, ph44 may require completion of KYC verification, including submission of a valid government-issued ID (such as a Philippine passport, SSS ID, UMID, or driver's license) and proof of address.
• Withdrawal requests are subject to review and may be delayed if ph44 identifies any suspicious activity, pending bonus wagering requirements, or incomplete verification.
• ph44 aims to process approved withdrawal requests promptly. Processing times may vary depending on the payment method selected and the volume of pending requests.
• ph44 reserves the right to withhold withdrawals pending investigation of any suspected breach of these Terms, fraudulent activity, or regulatory inquiry.

ph44 offers various bonuses and promotional offers to eligible players from time to time. All bonuses are subject to the following general terms, in addition to any specific terms attached to each individual promotion:

• Wagering Requirements: Bonus funds must be wagered a specified number of times before they or any associated winnings may be withdrawn. The applicable wagering requirement is stated in each promotion's specific terms.
• Eligible Games: Not all games contribute equally to wagering requirements. Live casino games, table games, and certain slots may contribute at a reduced rate or not at all. Contribution rates are specified in each promotion's terms.
• Time Limits: All bonuses are subject to an expiry period. Bonus funds and associated winnings that have not been wagered within the specified period will be forfeited automatically.
• One Bonus at a Time: Players may only hold one active bonus at a time unless explicitly stated otherwise in a promotion's specific terms.
• Bonus Abuse: ph44 reserves the right to void bonuses and associated winnings, and to suspend or close accounts, where it determines that a player has engaged in bonus abuse, including but not limited to: creating multiple accounts to claim bonuses, using automated betting strategies to exploit bonus terms, or colluding with other players.
• Eligibility: ph44 reserves the right to exclude any player from any promotion at its sole discretion. Promotions are intended for recreational players only.

ph44 reserves the right to modify, suspend, or withdraw any promotion at any time without prior notice. Any such changes will not affect bonuses already validly claimed and in active use at the time of the change.

All games available on the ph44 Platform are governed by individual game rules, which are accessible within each game interface. The following general principles apply across all games:

• Random Number Generators: All non-live games on ph44 use certified Random Number Generator (RNG) technology supplied by licensed third-party game providers. Game outcomes are determined randomly and are not influenced by ph44 or any player.
• Live Casino: Live casino games are conducted by human dealers in real time via video stream. The rules of each live game are displayed within the game interface and must be followed at all times.
• Malfunction Policy: In the event of a technical malfunction, game error, or system failure, ph44 reserves the right to void affected bets and refund the wagered amount to the player's account. ph44 is not liable for any losses arising from technical malfunctions beyond its reasonable control.

ph44 is committed to providing a fair gaming environment. Any player found to be using software, tools, or strategies designed to gain an unfair advantage over the Platform or other players will have their account suspended and winnings voided.

The following conduct is strictly prohibited on the ph44 Platform. Engaging in any prohibited conduct may result in immediate account suspension, forfeiture of balances, and referral to relevant law enforcement or regulatory authorities:

• Providing false, inaccurate, or misleading information during registration or at any point during your use of the Platform.
• Creating or operating more than one account on the Platform.
• Using the Platform for any unlawful purpose, including but not limited to money laundering, fraud, or financing of illegal activities.
• Attempting to manipulate game outcomes through the use of software bots, automated betting systems, exploits, or any other unauthorized means.
• Colluding with other players to gain an unfair advantage in any game.
• Engaging in any form of cheating, including chip dumping in poker or other collusive play in live games.
• Attempting to reverse-engineer, decompile, or otherwise tamper with the Platform's software or systems.
• Harassing, threatening, or abusing ph44 staff, support agents, or other players through any communication channel.
• Allowing any third party to access or use your ph44 account.
• Depositing funds derived from criminal activity or using the Platform to facilitate money laundering in violation of the Anti-Money Laundering Act of the Philippines (Republic Act No. 9160, as amended).

ph44 reserves the right to suspend, restrict, or permanently close any player account at its sole discretion. Circumstances that may lead to account action include, but are not limited to:

• Breach of any provision of these Terms & Conditions.
• Failure to complete KYC verification within the required timeframe.
• Suspected fraudulent activity, money laundering, or other illegal conduct.
• Identification of a player as being under 21 years of age.
• Receipt of a chargeback or payment dispute from a player's payment provider.
• A player's request for self-exclusion under ph44's Responsible Gaming policy.
• Regulatory direction or court order requiring account closure.

Where an account is closed due to a breach of these Terms, ph44 reserves the right to forfeit any remaining balance in the account. Where an account is closed for reasons unrelated to a breach (such as a player-initiated closure), any verified balance will be returned to the player via their registered payment method, subject to completion of any pending wagering requirements.

Players wishing to voluntarily close their account may do so by contacting ph44 support. Account closure requests will be processed within a reasonable timeframe.

All content on the ph44 Platform, including but not limited to text, graphics, logos, icons, images, audio clips, game software, and the overall design and layout of the Platform ("Content"), is the property of ph44 or its licensed content providers and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial gaming purposes only. This license does not include the right to:

• Copy, reproduce, distribute, or publicly display any Content without prior written consent from ph44.
• Modify, adapt, translate, or create derivative works based on any Content.
• Use any Content for commercial purposes or in any manner that competes with ph44's business.
• Remove or alter any copyright, trademark, or other proprietary notices from any Content.

Any unauthorized use of ph44's intellectual property is a violation of these Terms and may constitute an infringement of applicable intellectual property laws, for which ph44 reserves all legal remedies.

To the fullest extent permitted by applicable law, ph44 shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Platform, including but not limited to:

• Loss of funds resulting from unauthorized access to your account due to your failure to maintain account security.
• Losses arising from technical malfunctions, server downtime, or connectivity issues beyond ph44's reasonable control.
• Losses resulting from your reliance on any information provided on the Platform.
• Any indirect or consequential loss, including loss of profits, loss of data, or loss of opportunity.

ph44's total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Platform shall not exceed the total amount deposited by you into your ph44 account in the thirty (30) days immediately preceding the event giving rise to the claim.

Nothing in these Terms shall limit or exclude ph44's liability for fraud, gross negligence, or any other liability that cannot be excluded or limited under applicable Philippine law.

ph44 collects, processes, and stores personal data in accordance with its Privacy Policy, which forms an integral part of these Terms and is incorporated herein by reference. By using the Platform, you consent to the collection and processing of your personal data as described in the Privacy Policy.

ph44 complies with the Data Privacy Act of 2012 (Republic Act No. 10173) of the Philippines. Your personal data is collected for the purposes of account management, identity verification, fraud prevention, regulatory compliance, and improvement of the Platform's services.

ph44 will not sell your personal data to third parties. Data may be shared with licensed third-party service providers, payment processors, and regulatory authorities where required by law or necessary for the operation of the Platform. ph44 is committed to promoting responsible gaming and takes its duty of care to players seriously. We recognize that gambling can become problematic for some individuals and have implemented the following measures to support player welfare:

• Deposit Limits: Players may set daily, weekly, or monthly deposit limits on their accounts. Once set, limits take effect immediately and can only be increased after a mandatory cooling-off period.

Your continued use of the Platform following the effective date of any amendment constitutes your acceptance of the revised Terms.

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your use of the ph44 Platform, the parties shall first attempt to resolve the matter through good-faith negotiation. Players are encouraged to contact ph44 support in the first instance to seek an amicable resolution.

If a dispute cannot be resolved through negotiation within thirty (30) days, either party may refer the matter to the appropriate regulatory authority or to the courts of competent jurisdiction in the Philippines. ph44 operates within the regulatory framework of PAGCOR, and players may also raise complaints with PAGCOR where the dispute falls within its regulatory remit.

Nothing in this clause shall prevent ph44 from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction where necessary to protect its legitimate interests.
